Your continuous usage of Our Platform constitutes Your acceptance of the terms and conditions, incorporating any additional terms We may make available to You (Terms) and contractually confining on You.

You approve that in the case of any variance between these Terms and any further terms associated with the usage of Our Platform or any Contest; the additional terms will be prevalent. With the acceptance of these Terms, You agree and give your consent to get communications from Us and Our associates or partners through either of the following modes:

1. Direct Messages or administrative messages
2. Advertisements,
3. Announcements
4. Notifications to your account on Our Platform and,
5. Through any other channel that seems a perfect fit for the same purpose.

You accept that You shall mark Us as a secure sender on all platforms where You receive any communications from Us (via SMS and email) to ensure such communications are not sent to the Junk folder or Spam.

In order to partake in any paid contest, you must meet the following eligibility criteria:

• You must be above the age of 18 years.
• You must be living in India.
• You must have a valid Indian mobile number to make a profile on Cricksy.

Furthermore, remember that Paid Contests are not allowed in the following states.

1. Assam
2. Andhra Pradesh
3. Nagaland
4. Sikkim, and
5. Telangana

In order to use Our Services, you are required to register on Our Platform to create an account. While creating Your Account or at the time of utilization of Our Services, You will need to provide any or all of the following documents or information:

• Your full name
• Your team name
• Your mobile number
• Your full address and state of residence
• Your gender
• Your DOB (Date of Birth)
• Aadhar number
• Any other valid identity proof
• Bank account information
• PAN (Permanent Account Number)
• UPI ID

We reserve the right to conduct online KYC as may be needed from time to time in the way prescribed under such law.

By participating in our Contests, you agree to the following:

1. Creating a Team: To join a Contest, you need to create a fantasy team by selecting real-life players who are playing in the specific sport.
2. Finalizing Your Team: You must finalize your team before the Contest starts or before any adjusted time we specify (the "Contest Deadline"). We may inform you in advance if we extend the Contest Deadline.
3. Minimum Participants: Each Contest requires a minimum number of users to make it active (the "Pre-specified Number of Users").
4. Multiple Entries: In Contests that allow multiple entries, you can create several teams to join the Contest ("Multiple Entry Contest"). We may set a limit on how many teams you can submit for each Contest format.
5. Paid Contests: To join Paid Contests, you need to pay a specific amount shown on the Contest page ("Pre-Designated Amount").
6. Prize Pool: For each Contest, we create a prize pool from the money all participants contribute ("Prize Money Pool"). We do not claim any ownership of this Prize Money Pool.
7. Platform Fees: We may take a fee from your payment to cover our services ("Platform Fees"). The remaining amount goes into the Prize Money Pool.
8. Promotions and Offers: Occasionally, we may run promotions or offers on our platform. Your participation will follow the specific terms and conditions of those promotions.
9. Contest Limits:
   • You can join up to 2,000 Contests per cricket match.
   • You can create a maximum of 20 teams for any Contest you join.
10. Toss and Starting Lineup: Our toss and starting lineup feature is only to help you choose your team. We use data from third-party providers or public information to show which players are in the starting lineup.
11. Research Recommendation: Before creating your team, we recommend you research player statistics, pitch and weather conditions, player performances, team records, and the performance history of captains and vice-captains.

• Flexible Contest: A Contest is active even if only two users join.
• Non-Flexible Contest: A Contest is active only if the number of users meets the limit set by us for Public Contests or by you for Private Contests.
• Prize Money Pool: In Flexible Contests, the Prize Money Pool depends on the number of participants. If fewer users join than the set limit, the Prize Money Pool will be smaller.

A Public Contest allows you to join with other users without restrictions.

• Public Contests can be Flexible or Non-Flexible.
• We can cancel a Public Contest if not enough users join. If canceled, we will refund your payment without any deductions.
• "Guaranteed Contests" start when the required number of users join. The Prize Money Pool is fixed, and we will cover any shortfall if not enough users join.
• Winners are announced as per the Contest page, regardless of the number of participants.

A Private Contest is one you create and invite other users to join.

1. Naming: You must name your Private Contest.
2. User Limit: Set a limit on the number of participants (between 2 and 20,000 users).
3. Contest Type: Choose whether your Contest is Flexible or Non-Flexible.
4. Payment: Pay the Pre-Designated Amount to join.
5. Contest Code: After creating a Private Contest, you'll receive a unique code to share with others.
6. No Changes: Once created, you cannot change the terms of the Private Contest.
7. Joining: Invited users must enter the Contest Code and pay the Pre-Designated Amount to join.
8. Refunds: If, one hour before the Contest Deadline, the number of participants is below the required limit, we will refund the Pre-Designated Amount after the Contest Deadline.
9. No Liability: We are not responsible if invited users cannot join the Private Contest for reasons beyond our control.

• Teams earn points based on their performance at the end of the Contest.
• The team with the highest score wins ("Winners").
• In some Contests, there may be multiple Winners, and prizes are given based on the teams' total scores.
• Winners are determined by the highest scoring team in each Contest, which can last from 1 to 5 days.
• The number of Winners and the prizes are announced on the Contest page before the Contest starts.

• We use third-party data providers or official sports event websites to get scores and other information to calculate fantasy points.
• If there are errors in scoring due to incorrect information from data providers, we will try to fix them before giving out prizes.

• We or our third-party partners may contact Winners via the email you provided during account creation.
• Winners will be informed about the verification process and required documents to collect their prize.
• If you’re a Winner but haven’t received your prize, contact our Help and Support within 48 hours of the Winner announcement.
• Our decision regarding prize distribution is final and binding.

• The user with the highest points at the end of a match wins a prize from the Prize Money Pool as stated on the Contest page.
• If there is a tie, the prize is shared equally among the Winners.
• We can change the prize amounts before the Contest Deadline at our discretion.
• Prizes or rewards are subject to specific promotional event terms and conditions.
• We can disqualify Winners and prevent them from receiving prizes if:
  1. Information you provided is incorrect or misleading.
  2. You created teams for other users.
  3. You violate these Terms.
  4. You falsely declare your location or join from prohibited areas.

When you use our platform, you have two types of accounts for handling payments:

1. Unutilized Account: Holds any money you add through a payment gateway to use our Services.
2. Winning Account: Holds your winnings from any Paid Contests.

To run promotions and provide incentives, we may give you discounts to join Paid Public Contests ("Discount(s)"). You agree to the following:

• You cannot transfer or withdraw Discounts to any other account, including your bank account.
• Using Discounts is subject to specific terms provided when the Discount is issued.
• Discounts are given at our discretion and are not guaranteed.
• Discounts apply to the Pre-Designated Amount for joining any Contest.
• All Discounts are lost if your Account is terminated, and you have no rights to them.
• Discounts may take up to 24 hours to appear in your Discount account. We are not responsible for any delays or missed opportunities to join Contests due to Discount delays.
• If there is a conflict between these Terms and Discount-specific terms, the Discount terms take precedence.

1. Discount Points:
   • Given when you successfully deposit money into your Unutilized Account.
   • Valid for three months from issuance.
   • Used automatically to reduce the Pre-Designated Amount when joining Paid Contests.
   • If you request a refund, any Discount Points related to the refunded amount are lost.
   • If a match is canceled, Discount Points used are returned to your Discount Point Account.
2. Discount Bonus:
   • Given as part of promotions based on specific terms.
   • Credited to your Discount Bonus account after meeting promotion conditions.
   • Automatically deducted from the Pre-Designated Amount.
   • Valid for 14 days from credit.
3. Discount Coupons:
   • Given at our discretion with specific terms and validity.
   • If terms conflict with these Terms, Discount Coupon terms prevail.
4. Payment of Pre-Designated Amount
   • When you join a Contest, the Pre-Designated Amount is first deducted from your Unutilized Account and then from your Winning Account.
   • If you don’t have enough balance, you need to add more money. Deposits are subject to a 28% GST as per these Terms.
5. Withdrawals Processing
   • You must provide documents for verification when making your first withdrawal.
   • The name on your ID must match the name on your Account.
   • We verify your bank account details or UPI ID before transferring funds.
   • A processing fee may apply for online transfers.
   • Transfers may take up to 24 hours. We are not responsible for delays.
   • Once confirmed, transactions cannot be canceled.
6. Taxes Payable
   • From October 1, 2023, a 28% GST applies to money you add to your Unutilized Account. You can see the GST on the 'My Transaction' page.
   • All winnings are subject to a 30% TDS (Tax Deducted at Source) as per the Income Tax Act 1961.
   • Calculating Net Winnings (NW):
     1. First Withdrawal in a Financial Year (FY):
        • NW = Total Withdrawn (A) - (Non-taxable Deposits (B) + Opening Balance (C))
        • If B + C ≥ A, NW = 0
     2. Subsequent Withdrawals in the FY:
        • NW = Total Withdrawn (A) - (B + C + Previous NW (E))
        • If B + C + E ≥ A, NW = 0
     3. End of FY:
        • NW = (Total Withdrawn (A) + Closing Balance (D)) - (B + C + E)
        • If B + C + E ≥ A + D, NW = 0
   • If you don’t withdraw winnings by March 31, a 30% TDS is deducted from your NW balance.
   • If tax laws change, TDS will be adjusted accordingly.
   • You are responsible for any additional taxes on your winnings.

• We will refund any remaining money in your Unutilized Account if your Account is suspended or removed due to:
  1. Our failure to provide Services.
  2. Instructions from government or regulatory authorities.
• We will refund your payment if a Contest is canceled as per these Terms.
• If we deactivate your Account due to government instructions, we will refund the money to your original payment method, minus any processing fees.
• If Our Services are unavailable due to uncontrollable reasons (e.g., natural disasters, technical issues), we may cancel any Contest and refund the Pre-Designated Amount.
• Specific Refund Cases:
  1. For Paid Contests with up to 4 Users entering the same teams, the Pre-Designated Amount is refunded after the match starts.
  2. For Contests with 5 or more Users entering the same teams, the Prize Money Pool is equally divided among the Users.
• Withdrawal requests from the Unutilized Account will be refunded minus the 28% GST, which cannot be refunded as per government laws.

• You authorize us to appoint a third party (trustee or escrow agent) to hold your money and handle necessary actions.
• You acknowledge that:
  1. We do not own the money you deposit.
  2. Your money is only used to join Paid Contests.
  3. Your money will not be lost unless we are instructed by a government or authority.
• You also authorize us to have a non-interest bank account for:
  1. Withdrawing your winnings.
  2. Paying Platform Fees.
  3. Paying taxes like TDS and GST.

When using our Platform, you agree to the following:

• You can only create one Account.
• Provide true, accurate, and updated information when creating or updating your Account.
• Do not provide false information or impersonate someone else.
• Your address details will be used for tax purposes.
• Update your Account details promptly if they change and notify us if there's unauthorized use of your Account.

• Keep your Account information confidential.
• Do not share your One-Time Password (OTP) with anyone.
• Do not try to access another user's Account by asking for their information or OTP.

• Follow all applicable laws.
• Do not perform any illegal actions that disrupt our systems.

• Do not engage in any Fair Play Violations.
• Do not misuse Discounts, offers, or promotions.
• Use the Platform only for personal use, not for business or to gain unfair advantages.
• Do not share non-public information or strategies ("Insider Trading").
• Do not tamper with our data, software, or intellectual property.

• Participate in Contests responsibly.
• Make informed decisions and play within your means.
• Seek help if needed.

• We can remove any offensive, illegal, or infringing content you post without notice.
• We can take necessary actions regarding your content.

• We can:
  1. Update the list of available players based on official information.
  2. Cancel any Contest without notice if it becomes prohibited or requires government approvals.
  3. Change the Contest Deadline or abandon a Contest.

• The sport (other than cricket) is rescheduled before the Contest Deadline and starts more than 10 minutes before the Deadline.
• For cricket, if the Contest Deadline is extended by more than 10 minutes or after 3 overs have been bowled before the match starts.
• The sport is rescheduled after the Contest Deadline for reasons like weather, delays, technical issues, etc., and we cannot verify the new start time.

• For cricket, if rescheduled before the Deadline, we can extend the Deadline by up to 10 minutes or 3 overs before the official start time.
• If the cricket event's start time can't be verified, we can extend the Deadline until 3 overs are bowled.
• If the sport is rescheduled after the Deadline due to delays, we can extend the Deadline to match the new start time based on reliable sources.

If you break these Terms or we believe you have, we can:

1. Restrict, suspend, deactivate, or delete your Account and all related information.
2. Disqualify you from Contests.
3. Refrain from awarding prizes or take away your winnings.
4. Start legal actions, including civil or criminal proceedings, and seek to recover prize money.

• We own all intellectual property rights to the software and content on our Platform, including:
  1. Contests
  2. Software/technology
  3. Advertisements
  4. Written content
  5. Images, graphics, photos, illustrations
  6. Logos and trademarks
  7. Audio and visual clips
  8. Flash animations
• You agree not to:
  1. Modify, distribute, publish, transmit, reproduce, or use our intellectual property without permission.
  2. Create derivative works or exploit our intellectual property in any way.
• You agree that:
  1. You own the rights to your own content.
  2. Your content will not cause infringement claims.
  3. We are not responsible for your content on our Platform.
• You grant us a global, non-exclusive, royalty-free license to use your content to:
  1. Use, reproduce, distribute, publish, and transmit your content.
  2. Create derivative works for:
     • Displaying your content on our Platform.
     • Distributing or storing your content electronically or otherwise.
     • Storing your content in a remote database accessible by users for a fee.

• If you have complaints about:
  1. Any User Content you believe violates these Terms or infringes intellectual property.
  2. Your access to the Platform.
• Contact us by writing to: grievanceofficer@cricksy.com.
• Our Grievance Officer may contact you for more details or to verify your complaint.
• The Grievance Officer is appointed as per applicable laws like the Information Technology Act, 2000, and the Consumer Protection Act, 2019.
• We may change the Grievance Officer by updating their name and title on our website.
• Any complaints must be filed within thirty (30) days of the issue to be resolved.

• Our Fantasy Sports are games of skill and legally recognized as such by the Supreme Court of India and various High Courts.
• Success in our Contests is based on your knowledge and skill, not chance.

• Jurisdiction: Courts in Punjab have exclusive authority to handle any disputes related to our Services, including Contests.
• Law: Disputes are governed by the laws of the Republic of India.
• Dispute Process:
  1. If a legal dispute arises, the complaining party must send a written notification to the other party.
  2. Both parties will attempt to resolve the dispute through friendly discussions.
  3. If unresolved within fifteen (15) days of the notification, the dispute will go to arbitration.
  4. We will appoint a single arbitrator to handle the arbitration in English, following the Arbitration and Conciliation Act, 1996.
  5. The arbitration will take place in Ludhiana, Punjab.
  6. The arbitrator’s decision is final and binding.
  7. Each party pays for the arbitration costs and the arbitrator’s fees unless decided otherwise.
  8. The arbitrator can issue interim orders, including specific performance, which can be enforced in courts.
  9. The arbitrator must provide a reasoned award.
• Interim Relief: These Terms do not prevent us from seeking temporary or permanent legal relief from courts to protect our interests before, during, or after arbitration. Seeking such relief does not mean we waive the right to seek monetary damages through arbitration.

• Requesting Account Deletion

  If you wish to delete your account, please follow these steps:

  1. Open the app and navigate to the profile.
  2. Select the "Delete Account" option, or
  3. Contact our support team directly at Info@cricksy.com, with the subject "Account Deletion Request".
• Data Deletion

  Upon successful deletion of your account, the following data will be permanently erased from our systems:

  1. Personal account information (e.g., name, email address, contact details).
  2. Any usage data associated with your account.
  3. Any transaction records tied to your account.
• Data Retention Period
  1. For most users, all account data will be deleted immediately upon account deletion.
  2. However, certain data may be retained for a limited period as required by law or for legitimate business purposes, such as resolving disputes or complying with legal obligations. Typically, this data will be kept for no longer than 30 Days.
• Data Retention Exceptions
  1. In some cases, we may retain certain data even after account deletion, in compliance with applicable laws or contractual obligations.
